Diving Enterprises, Ltd Repair Agreement

Effective October 7, 2023

REPAIR AGREEMENT:  THIS AGREEMENT is entered into between Diving Enterprises, Ltd., and the Customer shown above, hereinafter "CUSTOMER", for the service and/or repair of equipment.  CUSTOMER agrees and states that CUSTOMER is the responsible party for this equipment and agrees that CUSTOMER or CUSTOMER's agent will be responsible for any charges related to the servicing of this equipment. 

THIS AGREEMENT is a release of the CUSTOMER'S rights to sue for injuries or death resulting from the use of the equipment after service/repair. CUSTOMER expressly assumes all risks in any way to use of this equipment. CUSTOMER understands that Diving Enterprises, Ltd. and its employees, owners, officers, or agents (hereinafter "Released Parties"), shall not be held liable or responsible in any way for any injury, death, or other damages to CUSTOMER or his/her family, heirs or assigns which may occur as a result of the use of the equipment after service/repair.

I, CUSTOMER, have carefully read and understand the above agreement. By signing this agreement, I exempt and release Diving Enterprises, Ltd, and all related entities as defined above, from all liability or responsibility whatsoever for personal injury, property damage, or wrongful death as a result of using the equipment, however caused, including, but not limited to product liability or the negligence of the released parties whether passive or active.  

I UNDERSTAND THAT EQUIPMENT WILL BE SERVICED TO THE STANDARDS ESTABLISHED BY THE MANUFACTURER AND/OR DIVING ENTERPRISES, LTD. I UNDERSTND AND AGREE THAT EQUIPMENT, ONCE DISSASSEMBLED, WILL NOT BE REASSESMBLED WITHUT COMPLETE SWERVICING BY DIVING ENTERPRISES, LTD.

I, CUSTOMER hereby authorize the above work. I agree that Diving Enterprises, Ltd will not be held responsible for loss or damage to my equipment as a result of fire, theft, accident, or any other cause beyond control.  Any equipment left after 30 days of notice of completion of work will be subject to a storage charge.  Any equipment left after 90 days may be sold without further notice.
